The video, which is included in the trial documents, is making the rounds on social media again and local media, as the man was sentenced to only ten years in prison.

The murder dates back to December 2021, in Spring, Texas. Carey Birmingham, then 60, had just discovered that his wife, Patricia, 48, had cheated on him. The two men argued for about half an hour in a heated tone, then the argument eventually moved to the street, where the man opened fire in front of his wife who was recording him. The two have a teenage daughter, Olivia, who was fortunately in school at the time. On March 5, 2024, an all-female jury sentenced Birmingham, who had previously pleaded guilty to the crime, to just 10 years in prison. The man was also fined $5,000 and will be eligible for parole in five years. Defense attorneys argued the shooting occurred at the height of a crime they described as “passionate,” a spur-of-the-moment sort of thing. The couple's daughter does not agree. “That day I lost both my parents. My father also died that day because the person who did this to my mother and my father are not the same,” Olivia told ABC. The teenager said she never saw her father physically abused his mother, but noted that he abused her financially and emotionally. And now he will fight to raise awareness about the phenomenon of domestic violence.
