Albania, the alarm of the investigating judges of Rome: “Cpr abroad? A legal headache and we are already understaffed”

A real “legal headache”. This is how the office of the investigating judge in Rome, on the fifth floor of Piazzale Clodio, defines the construction of the detention center for repatriation to Albania. In fact, the Italian judges will be responsible for all possible crimes committed by migrants within the institute under construction in Gjader, where some will be transferred. An additional burden for the Roman magistrates who already work with a thousand difficulties: “We are short of staff”, they report to The press.

“More skills, but resources are not increased”

Everything that happens inside the CPR of Gjader will be under Italian responsibility. Even possible crimes: from riots to assaults. Outside the perimeter of 77 thousand square meters will be the Albanian authorities. A device used to control the transfer of migrants from the Shenjing identification center to the current one in Gjader. But not only that, it is also about monitoring possible escapes or violence against Albanian citizens. The Italian judges complain that they already have short cover, there should be 41, but there are 32. But among them, there are 4 who benefit from exemptions, so the real number drops to 28: “It is a known problem. However, the investigating judge's office is accumulating skills, but the resources are not increasing,” they reveal in the corridors. The handcuffs will be removed in the event of flagrante delicto and the validation or not of the arrest will arrive more or less in 48 hours: “In this case the rules of direct judgments do not apply,” they explain.

The problem of bureaucracy

In addition to this, there would also be technical doubts that would worry and slow down the work of the judges: “Because each step represents a problem.” The prosecutor (public prosecutor) has 48 hours to communicate the arrest, the judge in turn must schedule the validation hearing within the following 48 hours: “Very long delays, as if it were a special trial for crimes that could be handled much more easily,” they explain. And then the accused must be present at the hearing, but if technology comes to the rescue, “classrooms with videoconferencing screens” are also needed. Those of the eighteenth section of the Civil Court could be used. But how will the defense lawyers be able to speak in complete confidentiality? And the interpreters? In short, there are still many technical problems open and to be solved. Last but not least, the place where the detainee will have to stay in the event of validation of his arrest.

Agents' remuneration

800 thousand euros have already been spent on the construction of two structures, one in Gjader and one in Shenjing. To these must be added the expenses related to the cost of the guard staff. It would be appropriate for prison officers, police officers, carabinieri and financiers to serve in the CPR in Albania. Three hundred people will receive an additional one hundred euros on their salary, plus food, accommodation and a paid ticket home. The costs, just for the staff, will reach 900 thousand euros per month.
