Safety at work, the “credit” license is coming for businesses and self-employed workers. Stitches removed after an accident: how it works

The “credit” authorization for safety at work arrives on October 1, 2024, provided for in the draft Pnrr decree expected in the afternoon on the table of the Council of Ministers and already rejected by the Uil and the CGIL, after the morning meeting between the Government and the social parties. Companies and self-employed workers who operate on temporary or mobile sites must have authorization. Among the proposals anticipated by the Minister of Labor Marina Calderone is that of reintroducing the crime of “illicit interposition of labor”, that is to say cases in which labor is provided without a regular supply contract nor regular secondment of staff. The authorization will be issued in digital form by the State Labor Inspectorate, based on the following requirements:

• registration with the Chamber of Commerce
• compliance with training obligations by the company and workers
• possession of Durc, the Single Contribution Regularity Document
• possession of the DVR, the Single Tax Regularity Document

Sanctions in the event of an accident

The license starts from 30 credits and allows you to work with an endowment equal to or greater than 15 credits. Can be deducted from the license:

• 20 points in the event of death of the worker
• 15 points for permanent, absolute or partial incapacity for work
• 10 points for absolute temporary incapacity resulting in abstention from work for more than 40 days

In the event of accidents “resulting in death or permanent incapacity for work, absolute or partial – specifies the draft cited by Il Sole 24 Ore – the competent territorial directorate of the Labor Inspectorate may suspend, as a precautionary measure, the permit of drive up to a maximum of twelve months”. Points “can be reinstated” after completing workplace safety refresher courses, which allow you to recover five points at a time. The credits recovered from the courses cannot exceed 15. Ten more, explains Repubblica, can be triggered automatically two years after the sanction, one per year. Companies that continue to operate with less than 15 credits are subject to a fine of 6,000 to 12,000 euros.
