He will serve the remainder of his sentence under house arrest with his daughter. This is what the cantonal review section of the Venice Court decided on Valentina Boscaro, 31, sentenced by the Court of Appeal to 20 years in prison for the murder of her boyfriend Mattia Caruso, on September 25, 2022 in Abano Terme (Padua). Boscaro will have to wear an electronic bracelet and will not be able to use smartphones or computers. For the victim's family, it is “a real blow”.
The condemnation
As he writes MailThe judge ordered Boscaro's immediate release from Montorio prison in the Veronese area: the woman has already returned home. On the evening of September 25, 2022, Boscaro and his partner went out to dinner at the Laghi di Sant'Antonio restaurant. When she returned, the woman had stabbed her boyfriend, Mattia Caruso, to death with a knife in the heart while he was driving. In the first instance, prosecutor Valeria Sanzari, who accused her of voluntary homicide aggravated by the emotional relationship, had requested life imprisonment for her. But Boscaro was sentenced to 24 years in prison.
“She never repented, cold and cruel”
“Valentina never regretted it, cold and cruel. He stabbed her in the heart with his right hand,” the prosecutor said in the indictment, disputing Boscaro's statements about the dynamics of the crime. “He always lied,” the prosecutor said: the 31-year-old had in fact supported the theory of an attack by a “Maghrebi”. A version that the woman had also provided to the first young people who intervened to help the couple. Sanzari had explained to the sender the motive for the stabbing “out of fear”: there were no signs of a struggle on the woman's body and clothes. According to the prosecutor, the accused had “the will to manipulate the seriousness of the fact”. On September 19, 2023, Boscaro told the judges: “Mattia beat me and raped me: he wanted me to get pregnant and threatened me. I didn't want to kill him, I'm sorry for what I did.”
The defense appeal to the Supreme Court
Boscaro's lawyers, Alberto Berardi and Renzo Fogliata, had appealed to the Court of Cassation in the previous months. The lawyers contested “the erroneous application of criminal law” on the aggravation of the precautionary measures and “the omitted, but essential, judgment on the insufficiency of house arrest as a sufficient guarantee”. For the lawyers, locking Boscaro in a cell due to the fear of escape, the risk of repeating the crime and the suspension of parental rights was excessive compared to the alternative of house arrest. The Court of Cassation therefore allowed the appeal and referred the whole thing to the Court of Revision of Venice. In particular, it was highlighted that Boscaro was the mother of a little girl. The 31-year-old woman, now at home, will only be able to communicate with her lawyers and her family.
Disappointment of the victim's relatives
Mattia Caruso's family prefers not to comment and expresses its disappointment through lawyer Francesca Betto who, together with her colleague Anna Desiderio, is assisting the civil party. For the family, explains Betto, it is “a real shock, especially for the mother since she mourns her son every day at the grave. However, continue to have faith in justice, because this provision is different from the decision of the Court of Appeal: we are sure that once the final sentence against Valentina Boscaro is handed down, the prison doors will reopen.”
